Auburn.Tale's Commission Terms of Service - TOS 2018 (UPDATED)

**By commissioning me (i.e. sending me payment through Paypal), you are agreeing to the terms listed in this document. Please note that these terms of service are final and I hold all commissioners to the same standard so that both parties are treated fairly. If there is something, in the terms listed, that you would like to discuss, please message me and inquire! It is entirely up to the customer to make sure that they have read the TOS COMPLETELY before commissioning. Thank you!**

 

 My work days vary as I also currently work outside of doing my art! I try my best to work on pieces each day but, like anyone else, I am inclined to days off. Again, if you have any questions or concerns feel free to contact me!

 

General Commission Information: 
        

1.  I OWN the rights to MY artwork. You may not use the artwork for money-gaining purposes, resale, or vast distribution. You may discuss with me buying the rights. This ALSO includes any characters designed SPECIFICALLY by me. If you intend to sell a design or character OF WHICH I HAVE ORIGINALLY CREATED AND OR OF A CHARACTER THAT I HAVE DRAWN, I ask that you contact me in regards to buying the rights to the artwork.

2. Since I OWN the rights to my artwork, you may not trace, reference, or use the artwork in ANY way other than for fursuiting, art collecting, etc. If you are confused by this rule, please contact me IMMEDIATELY.

3. I have the right to refuse any commission without giving a reason. This, however, rarely happens.

4. When and if you decide to commission me, I ask you to contact me and provide me a detailed reference/description of your character. If there is a specific pose or facial expression let me know that as well. If there is any other information you deem helpful please include it. Please try to have your payment READY as well. It is okay if your payment is not ready at the moment BUT please be aware that I do NOT start any drawing or work on your piece till payment is received in FULL. 

5. Don't rush me, please. I try to work in the order that I receive payment for commissions, and this will vary depending on what I feel like working on THAT DAY. Usually, my sketches go in the order that I receive payment. If you would like an order done quickly (rushed) please let me know right away when you place your order as there may be ADDITIONAL FEE's added for rushed/express work. It can take me an estimated one to four weeks if the queue is long or there are delays due to issues on my end. I will notify buyers if the wait time will exceed the 4 weeks, though this is extremely rare! The time is heavily based on how many commissions I have going at the moment as well as how complicated the pieces are! I appreciate your patience above anything else!

6. If you are commissioning me, please check my gallery's current works to make sure you like my style. My anatomy may change with the personality of your character.

7. I will draw any and everything a commissioner would like, excluding NSFW. If you do not have a reference sheet or picture of your character, I require an EXTENSIVE and DETAILED description. I would also ask for a color palette to be made up as well.

8. I allow changes and adjustments to the pieces as I work on them. I will not do DRASTIC changes (i.e. the whole piece) unless it is because I did something on the design wrong. (i.e. forgot to add part of fur pattern, horns not curved enough etc.)

9. If you are commissioning me, PLEASE make sure to check your notes/comments/DMs frequently. I may ask questions as to make the experience pleasurable for every party involved.

10. At the current moment I accept PAYPAL and Card payments via Invoicing through Paypal. Please note that I only start commissions upon receiving payment.

11. I am not responsible for what happens to the commission in the mail. If a piece is lost, we can discuss ways to repair the situation. Commissions that are bent upon arrival are not my liability. (**Note that you DO have access to a digital copy of the commission since I do take cropped pictures of all commissions before mailing.**)

12. You may request a refund for a commission only at the Rough lineart stages. Once coloring has begun I will no longer be able to refund you!

13. When commissions are completed, I contact you to let you know. I will ask at this point for shipping information (if needed). Digital pieces I will email the full sized piece to you! Please contact me if this is an issue!

14. When addressing commission packages, I do include a notation on the back stating for postal services to not bend commissions due to fragile items inside. However, I am still not liable for commissions that are bent upon arrival (note that you can send laminated badges through a laminator in order to flatten them out if your commission arrives bent).

15. Please do not hesitate to contact me about your commission! I offer to send update pictures of your piece whenever you ask! Please be aware that I may not have an updated picture for you every day as I may be working on other commissions as well OR your piece may not have been started yet!

16. Tips are appreciated, but not necessary!

 

What Can You Do With My Artwork?

 

Upon receiving your commission, YOU ARE ALLOWED TO:

• You may upload the image to any of your art galleries of your choosing. I kindly ask that if you do so, to please properly credit me and link back to my gallery.

• You may print out whatever work I do for you. You may hang it on your wall, show it off to friends, etc.

• You may sell the work for THE PRICE YOU PAID FOR IT. If you are selling a character bundle, you must not charge more than what you paid for the work.

 

Upon receiving your commission, YOU ARE NOT ALLOWED TO:

• You are NOT ALLOWED to use my artwork to gain a profit. You are NOT ALLOWED to sell copies of your commission, you are NOT ALLOWED to put it on a t-shirt or other product to sell. Your commission is STRICTLY and ONLY for PERSONAL USE.

• You are NOT ALLOWED to claim the work as your own (this is obvious, but needs to be stated).

• You are NOT ALLOWED to deface or destroy the commission in any way, such as drawing on top of it to 'ruin' it in any way. If I ever find out you defaced my hard work, any further business with you will be terminated.

• You are NOT ALLOWED to trace the commission to create a 'base' for you or other people to color. They are not to be used to make bases for adoptables, etc. A commission is meant to be an original work by an artist SPECIFICALLY created for you. You are violating my terms of copyright by tracing and or referencing any piece you purchase from me.

• You are NOT ALLOWED to resell my artwork (ESPECIALLY at a higher price). A commission is a piece of art created for someone personally, in no way should it be resold.

 

 

Customer Satisfaction: [2018] If there is a problem with the commission, it is YOUR responsibility to tell me before the piece is completed! You can ask for update pictures from me OR watch me work on it via Twitch to avoid this issue! It is YOUR responsibility to let me, as the artist, know everything in advance before you proceed to let me work freely. I provide work in progress photos via Instagram, Furry Amino and email throughout the ENTIRE PROCESS at your request. You will not be refunded for work that you are not satisfied with. We can come to a consensus about where the issue lies, but I provide too many opportunities for changes and cannot afford to refund commissions after they have been completed. (as previously stated in my terms and conditions). Please make sure that you are okay with MY interpretation of your character; our brains are not the same, so clarification is prudent.

 

Discounts & Coupons: [2018] If you are a frequent customer, I am inclined to repay your business with discounts. These discounts could be percentages off or dollar amounts off the final price of a commission. Note that this is given RANDOMLY to customers. Do not beg me for discounts because you purchase artwork from me. My discounts or coupons are meant to repay you for your kindness. Asking for them does not make me want to repay you. Make sense? I want to reward you for helping me with my dream! :)

Mailing Regarding Customs Fees: [2018] As per the rules stated, once I have mailed the artwork (aka paid the shipping fee) I AM NO LONGER RESPONSIBLE FOR ANY ADDITIONAL FEES IT MAY TAKE FOR YOU TO GET YOUR WORK. I am not responsible for the customs fees in your country. YOU should be doing the research on this before commissioning me. It is not my responsibility to make sure that you are not paying an additional fee on top of what you have already paid for my work. Please inquire about this BEFORE commissioning me, because I am not at fault if your country charges you additional for the piece is marked as a custom (as will happen with keychain merchandise).

 

Reference Requirements: [2018] I will accept any reference. Fursuits, photos of people, etc will be acceptable forms of reference. I require detailed information due to color matching, and will not be held liable if color matching is not correct per the reference YOU provide. I will not scour your page for references; all references MUST be sent to me upon requesting a commission. I may message you about this if I have any questions.
